Is my Los Angeles apartment building subject to rent control (RSO)?
In the City of Los Angeles, a rental property is generally covered by the Rent Stabilization Ordinance (RSO) if it has two or more units and its certificate of occupancy was issued on or before October 1, 1978. RSO caps annual rent increases for sitting tenants and restricts evictions to specific "just causes." Buildings first occupied after that date are typically exempt from RSO but usually still fall under California's statewide cap, AB 1482.
How to check a specific property.
The LA Housing Department (LAHD) maintains a ZIMAS/RSO lookup by address. As a rule of thumb: pre-1979 certificate of occupancy plus two or more units in LA city limits means RSO. Separate cities inside the county — Long Beach, Glendale, Burbank, Inglewood and others — have their own rules, so the same building two blocks away can trade on completely different math.
What RSO means for value.
RSO is the reason LA multifamily trades on two sets of numbers: in-place income and market-rent potential. Loss-to-lease in a long-held RSO building is often 20–40%. Buyers underwrite how fast units realistically turn, what relocation costs look like, and whether the lot itself (TOC, ED1 density) is worth more than the income stream. Value-add buyers pay for that spread between in-place and potential; naive pricing misjudges it in both directions.
How much can rent go up per year under LA RSO?
The allowable annual increase is set by LAHD and changes year to year — historically in the 3–4% range for most units, with surcharges possible for utilities. Always confirm the current figure with LAHD before underwriting.
Does RSO limit the rent on a vacant unit?
No. LA RSO allows vacancy decontrol — when a tenant leaves voluntarily or is evicted for cause, the unit can be re-rented at market. That is why unit turnover drives value-add math.
Is a fourplex I live in still covered?
Owner-occupancy does not exempt a pre-1979 multi-unit building from RSO, though some specific unit types and situations have carve-outs. Check the address with LAHD.
